Title: Stupid Ebay lady
Post by: rbcp on June 06, 2007, 08:23:55 PM
Dear Jammie,
For the past year I've been selling Illinois deer harvest buttons on Ebay.  Whenever you shoot a deer in Illinois, I guess they give you a button to prove it.  I've made a ton of money from these.  The first few I sold, I got more than $20 PER BUTTON from.  I've been steadily lowering the price of the buttons over the past year as I've saturated the deer harvest button market.  Currently I'm selling sets of 10 for $20 each.  Still a very nice profit.

So this lady on Ebay buys a ton of them from me last week.  Like $80 for about 40 buttons.  She paid me with PayPal and I sent her the buttons.  Then yesterday I get this email from her:

Brad, I want to thank you for sending the buttons, but they are not what I
was looking for. I was wanting the actual (original) buttons. I am returning
the package to you, June 7th. I am so sorry for the inconvience this may
cause you, I was really excited when I ordered them, thinking they were the
originals, but I never guessed that they were not.

Again I am sorry,
Tracy

The problem with my deer harvest buttons is that they're a bit smaller than real deer harvest buttons.  I think the real ones are 1 1/2" and my fake ones are 1".  So if someone has some real buttons and they buy my fake ones to complete the set, the sizes are a little off.  But I'm very clear about this in the auction.  The very first sentence explains that these are replicas and that they're just an inch in diameter.  I'm not trying to trick anyone into buying cheap knockoffs.  I'm very upfront about these being replicas.  I even have a few repeat customers.  Nobody else has a problem with these being replicas and if they do they just don't buy them.   So I send her this reply:

I don't offer refunds.  The auction clearly stated that these were
replicas.  That was the very first sentence in the auction.  I even
wrote the word REPLICAS in all capital letters to avoid confusion.  I
also wrote in the auction that the buttons were brand new.  There was
no guessing about it.

Brad

This evening I get the following email back from her:

Brad, I am again sorry. I am very new to buying on ebay, so I did not
honestly see anywhere it stating that these were new or replicas. I had
already placed the pkg in the mail today & you should be receiving it by
Saturday, Monday the latest. I am begging you to please take them back. If
you could charge me $25.00 for the trouble I have caused you, I would be
more than wiliing to pay you that amount. I feel like such a dumb#$@ for not
seeing things when I ordered. I guess this is why I have never really
ordered before, I have been scared to, and now I know why. Please I
sincerely ask you to consider my offer.
Please & Sorry,
Tracy

So now she's already sent the buttons back to me and wants a refund.  My question is, do I give it to her?  Or do I send the buttons back to her?  I don't feel like this is my fault.  I don't think it matters that she's new to Ebay.  She totally fails at reading comprehension and that's nothing to do with being new to Ebay.  I do feel bad for her, mostly because she's being nice about the whole thing.  But on the other hand, she's an idiot and I hate her.  The $80 really isn't the issue.  It's the principle.  I shouldn't have to deal with refunds when there's absolutely nothing wrong with the product.

What should I do?

Brad

Dearest Brad,

My first instinct is to tell you to write "Return to Sender" on the package and not accept a refund.  I think pretty much everyone has to learn the ebay/online purchasing lesson at one point or another and it would be a disservice to her to let her think she can be such a fuckup and get away with it.  My roomate also mentioned to me this news article she read in which this guy sold an empty playstation BOX and a 12-year old bought it for a grand, but under ebay rules he didn't have to refund the money no matter how pissed the mom was.  Lesson to the mom to not be such an irresponsible parent if you ask me.

Now... mine and Rachel's second thoughts... if she paid through PayPal, there is a possibility that she could withdraw the payment (if she knows any better or a friend tells her to) and if that's the case, you risk getting your account frozen, and I don't think you'd appreciate that a whole lot.  I hear PayPal tends to side with the buyer.

So take that as you will and let me know how it goes!  Dumb bitch!

Love,
jammie

If you choose to pay her, rub poop all over a money order and send it to her.

I did the RETURN TO SENDER thing.  Haven't heard anything from her yet.  Jammie made the hilarious suggestion to me today that if she contacts me again to tell her that I don't have time to write emails because I'm going out to a nice steak dinner with her money.

^Mr.Internet!  Al Gore the watermelon: Green on the outside, Red on the inside.  (anyway...)

Yes, the worst I've ever done is bought a PS2 game for my Xbox or something, big deal.  But this is a rite of passage!  She needs to learn but she didn't listen to you the first time + sent it back anyway, I hate that shit - bitch better respek.

I saw this episode of Judge Judy where this girl sold an older lady a PIC of a digital camera for like $250, instead of the real thing.  It's simple to litigate, look at the listing, it is what it is.  Which in this case was a real camera - buyer wins!

You should try and keep her a satisfied customer by sending her some extra deer buttons for free.

Maybe make some new ones with a steering wheel on them. As soon as I saw those buttons I wondered: What do they give you if you hit a deer with your car?

You did the right thing.  She needs to learn to read not only the auction verbiage, but Ebay's terms regarding buying from their service.

Also, this is almost the equivalent of someone buying from a yard sale, then coming back a week later and asking for a refund.  Yeah, right.

You handled this all wrong. You should have taken the buttons back and sent the lady a refund invoice.

REFUND BTTNS#40:                 -80.00
         LIFE LESSON:                  17.00
                      S&H:                   6.00
                                           ------------
            SALES TAX:                   2.30
         DUMBASS TAX:            The rest.
                                           ------------
                TOTAL                     0.00

              ***PAID IN FULL***

And then sold the buttons to someone else for twice as much.

You know you've got her phone number saved up for a rainy day. You can take your $80 out of her longevity
