I've always heard that as long as you're not interfering with a legitimate FM station, the FCC will only send you a warning and tell you to quit if they find out.  And the likelihood of the music industry suing you for playing unlicensed music is probably really low too.

Why bother with FM though?  You'll be lucky to have 1 listener on there and you won't even know if you do or not since there's no way to check stats.  If it's just for the technical challenge of it all, then it's a great idea.  But if you're doing it to start up a show and have listeners, it's a horrible idea.  You can get a streaming internet station for under $10/month.  And you can even become a licensed internet station for an extra $10/month at http://www.loudcity.net/ (http://www.loudcity.net/).  Or you can probably talk me into letting you DJ on Cacti Radio for free.

Do you have any content in mind already?

Because there's no better radio than dead, awkward air!
