Seattle is being sued by the Yellow Pages.
Two publishers of the yellow pages and an industry group are suing over Seattle's new rule which allows city residents to "opt out" of receiving the phone books.
The industry says that's unconstitutional because it violates free speech. It will also cost them money.
"We still believe what we passed this fall is constitutional," says Seattle City councilman Mike O'Brien. He says the rule is expected to take effect April 1st.
The law requires yellow page distributors to get a license from the city, honor the opt-out list the city creates, "and also to pay a fee for the cost, to the citizens, of recycling all the yellow pages that they dump on our doorsteps."
O'Brien says Seattle residents now pay $350,000 a year to recycle unwanted phone books.
