Legal trashing.
« on: May 12, 2009, 02:12:42 AM »
In the great state of Oregon Dumpster Diving is %100 legal!  ;D Once it hits the can on the curb (Or general pickup site) it is public domain and that means fair game. Unfortunately, this also means that cops can dig through your trash without a warrant.   :'(

What if the dumpster area is considered private property?  Or if it's behind a fence.  Could they get you for trespassing still?

Probably.

I could be wrong, but I think NY and WI both have similar laws regarding discarded objects.

Correct.  Curbside trash is public property (though if you make a mess or bother people as you're digging in curbside trash they might get you on littering or disturbing the peace or some damn thing) but if you dumpster-dive on private property you're trespassing.  I think that's the deal in most places.

When it comes to dumpsters on private property, some people will have more leeway than others. For example if you live in an apartment complex with dumpsters, you can go diving without any trouble. If the cops show up just say you threw something away by mistake. Since you live there, you're not trespassing.

If it's a dumpster on your job site the cops will probably be suspicios. Your employer even more.
