I use to get my brother free internet from his neighbors by using a packet sniffer to get the WEP key. Is this illegal?

...... yes

if i was stealing internet the police in my area would be like "he's using one of those goddamn computer things I CLEARLY HAVE NO IDEA WHAT I'M TALKING ABOUT, EVER. anything about that but he has long hair lets slip some pot in his pocket and arrest him for possession with intent to sell."

Though a minute possibility, you may want to consider that the owner is aware that the AP is open and is sniffing your traffic just to toy with you since you really couldn't complain because you were thieving their connection. ;)

At the risk of a sound flaming i gotta ask.

Within 6 blocks of my house there are upwards of 8 unsecured wifi networks.

Say i jump onto one of them and check the weather or what ever, cosidering the fact that they are totally unsecure would this also be illegal?

How would anyone know that i was ever there ?

Look at the router logs for connecting MAC address / computer name, though most consumer AP's don't keep these detailed of logs.

Skn00b

there are many ways to get around mac address logging, the easiest is to delete the logs  since the point is open the router password is probably default look up the default pass for that brand of router and your in. if you cant find the info on the internet try a combo of default, admin, pass and 12345 for user names and passwords.

you could also use a program to spoof you mac address, and there not hard to find if you can work the Google  on the internet machine.

Definition - default:

Quote
a value that a program or operating system assumes, or a course of action that a program or operating system will take, when the user or programmer specifies no overriding value or action.

Would you be able to take over their AP because they have encryption turned off and the username/password was left to the default settings, yes, but would you be able to remotely log into the AP, from the WAN port, without changing any settings, no.

(almost) no system has remote login enabled by default. That would be just asking for all sorts of trouble.
